We at HYV Protocol, reserve all copyrights on text or images on the platform. The text or images in the platform may not be copied or distributed without prior permission of HYV Protocol. If there is any approved use of content, the following conditions should be followed: The source of copied material should be mentioned as HYV Protocol, this statement should appear on all forms of distribution.

Risk Acknowledgement

Cryptocurrency investment holds a higher risk level. You acknowledge that the value of HYV coins is highly volatile and that the project is dependent on the success of the presale. HYV Protocol Network does not guarantee any specific outcomes or the successful launch of the project.

Eligibility and Participation

To participate in the presale, you must meet the eligibility criteria set out in this section and in the "Purchaser Representations and Warranties" section below. The HYV presale is not open to Restricted Persons (as defined below), including, without limitation, residents of and persons located in the United States and the United Kingdom. It is your sole responsibility to determine whether you are legally permitted to participate in the presale in your jurisdiction, and HYV Protocol accepts no liability if you participate in breach of this requirement.

Restricted Persons; Sanctions

For the purposes of these Terms:

"Restricted Jurisdiction" means the United States of America (including its territories, possessions, and the District of Columbia) and the United Kingdom of Great Britain and Northern Ireland.

"U.S. Person" means: (a) any natural person resident in the United States; (b) any entity organized or incorporated under the laws of the United States; (c) any estate of which an executor or administrator is a U.S. Person; (d) any trust of which a trustee is a U.S. Person; (e) any agency or branch of a non-U.S. entity located in the United States; (f) any non-discretionary or similar account (other than an estate or trust) held by a dealer or other fiduciary for the benefit of a U.S. Person; and (g) any partnership or corporation organized or incorporated principally for the purpose of investment by U.S. Persons.

"Sanctioned Person" means a person or entity that: (a) is listed on the Specially Designated Nationals and Blocked Persons List maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), or is otherwise a party with which dealings are prohibited under the Laws of the United States; (b) is a citizen or resident of, or incorporated in, a jurisdiction identified as high-risk by the latest public statements of the Financial Action Task Force ("FATF"), a State Sponsor of Terrorism as identified by the U.S. Department of State, or a high-risk jurisdiction identified by the European Commission; (c) is identified as a terrorist organisation on any list maintained by a governmental authority; or (d) is a senior foreign political figure, or an immediate family member or close associate of one.

"Restricted Person" means any person who is a resident of, or located in, a Restricted Jurisdiction, a U.S. Person, or a Sanctioned Person.

The HYV presale is not offered to, and HYV Protocol will not knowingly sell HYV tokens to, any Restricted Person. If you are a Restricted Person, you must not attempt to participate in the presale, including by using a VPN or other means to disguise your location.

Purchaser Representations and Warranties

By participating in the presale, including by confirming the attestations presented to you before you access the presale page, you represent and warrant to HYV Protocol, on an ongoing basis, that:

(a) you are not a resident of, or physically located in, a Restricted Jurisdiction;
(b) you are not a U.S. Person;
(c) you are not a Sanctioned Person, and you are not owned or controlled, directly or indirectly, by a Sanctioned Person;
(d) you are at least 18 years old, or the age of legal majority in your jurisdiction if higher;
(e) you are purchasing HYV tokens for your own account, for your own benefit, and not on behalf of, as nominee for, or for the benefit of, any other person;
(f) you will not sell, transfer, or otherwise make HYV tokens available, directly or indirectly, to any Restricted Person; and
(g) you have read, understood, and agree to be bound by these Terms in full, including the Risk Acknowledgement and No Liability sections above.

These representations are a condition of your participation in the presale. HYV Protocol is relying on them, has not independently verified them, and reserves the right to refuse, cancel, or, to the extent technically possible, reverse any purchase made in breach of them. You agree to indemnify HYV Protocol against any loss, liability, or expense arising from any representation in this section being untrue.

Cancellation and Refunds

Purchases of HYV tokens are made by sending cryptocurrency to the presale smart contract and are confirmed on the relevant blockchain. Because blockchain transactions are irreversible, HYV Protocol is generally unable to cancel, reverse, or refund a purchase once it has been confirmed on-chain, and by confirming a transaction in your wallet you acknowledge that you will not be able to change your mind afterwards.

If HYV Protocol cancels the presale, or is otherwise unable to deliver HYV tokens for a purchase you have made, you will be entitled to a refund of the amount you contributed for that purchase, in the same cryptocurrency, less any unavoidable network fees.

Nothing in this section limits any cancellation or refund right you may have under mandatory consumer-protection law that applies to you and cannot be excluded by agreement.

Governing Law and Disputes

These Terms, and any dispute arising out of or in connection with them or the presale, are governed by the laws of the United Kingdom. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, without prejudice to any mandatory right you may have to bring proceedings in the courts of your own country of residence. Before starting formal proceedings, the parties shall first attempt in good faith to resolve the dispute by negotiation, using the contact details on our Contact page.

No Liability

HYV Protocol, its affiliates, and its officers shall not be liable for any loss or damage arising from your participation in the presale or use of the website. You agree to not hold HYV Protocol responsible for any claims, damages, or expenses arising from your breach of these Terms.

Changes to the Terms

HYV Protocol Network has the right to update and modify these Terms at any time. We will provide notice of any significant changes, and your continued use of the website following such changes will constitute your acceptance of the new Terms.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third-party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with and its licensors.

Third Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”). If you use any Third-Party Services, you understand that: Any use of a Third-Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services. You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate the Agreement or your account, you may simply discontinue using our Services. All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.
